Dans le cadre de la mise en oeuvre du protocole, il a été crée, par arrêté interministériel n°045 MCI/MSHP/MPMBPE du 19 décembre 2019, un Comité Technique du Système(CTS) de marquage,de suivi, de traçabilité, et de vérification fiscale des produits du tabac fabriqués ou importés en Côte dIvoire.
Le CTS est chargé de:
-mettre en oeuvre larticle 8 relatif au suivi et traçabilité du Protocole de lOMS pour éliminer le commerce illicite des produits du tabac;
-valider le choix du système de marquage, de suivi, de traçabilité et de vérification fiscale des produits du tabac fabriqués ou importés en Côte dIvoire, conforme aux normes du Protocole;
-contrôler et de veiller à la bonne exécution du système de marquage, de suivi, de traçabilité et de vérification fiscale des produits du tabac fabriqués ou importés en Côte dIvoire;
-assurer le suivi du système de marquage, de suivi, de traçabilité et de vérification fiscale des produits du tabac fabriqués ou importés en Côte dIvoire;
-formuler des recommandations pour assurer un bon fonctionnement du système de marquage, de suivi, de traçabilité et de vérification fiscale des produits du tabac fabriqués ou importés en Côte dIvoire;
-établir chaque trimestre un rapport dactivités à transmettre aux Ministres de tutelles.

Les recommandations issus des ateliers sur la transposition du Protocole pour éliminer le commerce illicite du tabac et des produits du tabac sont:
• Doter le commerce de moyens pour mettre en œuvre le système de traçabilité et de marquage;
• Trouver des moyens pour contrôler les frontières ;
• Mesurer l’impact de la hausse du prix du tabac sur la fiscalité ;
• Mettre en place une entente entre tous les pays (coopération internationale, régionale et sous régionale) ;
• Collaboration entre le PNLT et les différentes structures impliquées ;
• Partage de données entre le commerce et le PNLT ;
• Formation de formateurs ;
• Recrutement d’un personnel adéquat ;
• Mettre en place un comité interministériel et y associer la présidence (Bureau Organisation et Méthode);
• Elaborer une circulaire sur la transposition des lois ;
• Elaborer un plan d’action qui sera soumis à l’OMS pour sa mise en œuvre ;
• Mettre en place un groupe d’experts pour faire la commande;

National institutions in charge of alignment of national legal acts with the EU acquis have taken part in PLAC III project that is taking place in the Republic of Serbia from January 2019 till April 2021 in order to improve further building of capacities of relevant national structures for successful carrying out of accession negotiations. Ministry of Finance – Tobacco Administration and other competent authorities are beneficiaries of the activity that aims to provide assistance in assessing national legislation and its compliance with the Union aquis, as well as drafting aquis-compliant regulations and thus harmonizing national legislation with Union acquis (Directive 2014/40/EU) in regard to tobacco sector, with consideration of the practical aspects and challenges in the implementation of the harmonized legislation. |
