The obligations under Article 8.12 which shall not be delegated to the tobacco industry include:
• establishment and control of a tracking and tracing system, putting in place the requirement for unique, secure and non-removable identification markings,
• availability of prescribed information, recorded at a specific time, properly formatted and accessible via the global-information-sharing focal point on request,
• further development and expansion of its system’s scope.
In the EU system, none of these obligations have been delegated to the tobacco industry.
The EU system also has further specific measures such as:
• Clearly defined requirements on independence (i.e. legal independence, financial independence, absence of conflict of interest).
• The generation of unique identifiers by an independent third party to be appointed by Member States.
• Verification process of unique identifiers is protected with an anti-tampering device supplied and installed by an independent third party.
• All unique identifiers (applied to unit packets) must be secured as part of the generation process so that they cannot be tampered with once delivered to an economic operator.
• Data encoded in the unique identifiers, once delivered to the independent data storage services, cannot be altered or accessed by any economic operator; only Member States, the Commission, and external auditors have access to the recorded data;
• Clearly defined rules on the validation of data and its instantaneous access by national authorities and the Commission via the central functionalities provided by the secondary data repository.

Tobacco Industry monitoring is strictly done as in line with article 5.3 of the WHO FCTC. Since the implementation of excise stamps in 2008, the excise stamps are procured by the competent authority through open tender exercise and then sold to importers for affixing on packs at the factory. |

La República de Panamá ha incorporado en la Resolución 2175 de 2016, de la Comisión Nacional de Control de Tabaco, el Decreto Ejecutivo 178 de 8 de junio de 2018 que modifica artículos del Decreto Ejecutivo 63 de 27 de 2003, que crea el Consejo Nacional para la Salud sin Tabaco y el Decreto Ejecutivo 237 de la Comisión Interinstitucional para la implementación del Protocolo para la Eliminación del Comercio Ilícito de Productos de Tabaco, las disposiciones del articulo 5.3 del Convenio Marco de la OMS para el Control de Tabaco como una forma de control de la interferencia de la industria tabacalera en las decisiones y políticas de salud del Gobierno.

Le Sénégal a mis en place un Programme national de Lutte contre le Tabac (PNLT) par arrête n° 15 347 du 23 juillet 2015 qui est la structure de veille et dalerte en cas non respect des obligations auxquelles notre gouvernement est tenu. Il a pour missions de :
Préparer, et de mettre en œuvre le plan stratégique du département pour la lutte contre le tabac ;
Veiller à l’application des textes législatifs et réglementaires relatifs à la lutte contre le tabac ;
Promouvoir par tous moyens la lutte contre le tabac ;
Assurer l’information, la sensibilisation et la communication en matière de lutte contre le tabac.
En outre, le Programme national de Lutte contre le Tabac a aussi pour mission d’appuyer et d’accompagner les différents départements ministériels et autres administrations publiques dans la lutte contre le tabac.
En plus la loi 2014- du 28 mars 2014 dans son article premier stipule: " LEtat s interdit formellement toute ingérence de lindustrie du tabac dans les politiques nationales de santé". |
