Ecuador La Autoridad Ambiental Nacional publicó el Código Orgánico del Ambiente el 12 de abril de 2017 el cual tiene por objeto garantizar el derecho de las personas a vivir en un ambiente sano y ecológicamente equilibrado, así como proteger los derechos de la naturaleza para la realización del buen vivir o sumak kawsay. Las disposiciones de este Código regulan los derechos, deberes y garantías ambientales contenidos en la Constitución, así como los instrumentos que fortalecen su ejercicio, los que deberán asegurar la sostenibilidad, conservación, protección y restauración del ambiente, sin perjuicio de lo que establezcan otras leyes sobre la materia que garanticen los mismos fines. Además La Autoridad Ambiental Nacional publicó el Reglamento al Código Orgánico del Ambiente el mismo que desarrolla y estructura la normativa necesaria para dotar de aplicabilidad a lo dispuesto en el Código Orgánico del Ambiente. Constituye normativa de obligatorio cumplimiento para todas las entidades, organismos y dependencias que comprenden el sector público central y autónomo descentralizado, personas naturales y jurídicas, comunas, comunidades, pueblos, nacionalidades y colectivos, que se encuentren permanente o temporalmente en el territorio nacional. El artículo 331 del mencionado Acuerdo establece los criterios para determinar las normas de emisión, descargas y vertidos que deben considerarse, estos se detallan a continuación: - Tipos de fuentes y actividades reguladas. - Los valores de fondo o distribución del contaminante en el área de aplicación de la norma, su metodología de medición y los resultados encontrados. - La relación entre las emisiones, vertidos y descargas del contaminante y la calidad ambiental del recurso. - La capacidad de asimilación y de auto depuración del medio receptor o recurso involucrado en la materia normada. - Los efectos que produce el contaminante sobre la salud de las personas, la flora y fauna. - Las tecnologías aplicadas a cada caso y un análisis de la factibilidad técnica y económica de su implementación. Dentro de la regulación ambiental, se establece la aprobación y seguimiento al cumplimiento de Planes de Manejo Ambientales por parte de la Autoridad Ambiental de Aplicación Responsable. La industria regulada en el plazo de un año deben cumplir con las medidas aprobadas por la Autoridad, mediante informes de cumplimiento en parámetros físico-químicos de descargas de efluentes provenientes de calderos y áreas de producción, emisiones de gases de fuentes fijas (caldero), mediciones de Niveles de Presión Sonora (Ruido Laboral e Industrial), manejo integral de los desechos sólidos y manejo de desechos peligrosos con gestores autorizados. European Union Directive 2019/904 on the reduction of the impact of certain plastic products on the environment" (Single-use plastics Directive- SUPD) was adopted in 2019. The SUPD implements measures in respect of ‘tobacco products with filters’ taking into consideration the protection of the environment and the protection of health following Article 1 SUPD. En España, se pueden distinguir medidas de protección del medio ambiente en los siguientes ámbitos: * Dentro del primer pilar de la política agraria comunitaria (PAC): En el marco de los pagos directos, la última reforma de la PAC da una mayor importancia a la sostenibilidad medioambiental de la agricultura dentro del primer pilar de la PAC, en la UE. Así, esta nueva PAC dentro de los pagos directos, ha introducido un nuevo pago denominado “Pago para prácticas agrícolas beneficiosas para el clima y el medio ambiente” (conocida comúnmente como “greening” o “pago verde”). Este pago es obligatorio para los agricultores y cuenta con una dotación presupuestaria de un 30% del sobre nacional de cada Estado miembro, de la UE, dentro de los pagos directos. Se concede un pago anual por cada hectárea admisible, siempre que se respeten determinadas prácticas medioambientales, dependiendo de la estructura de la explotación. Así, los agricultores con derecho a un pago en virtud del “régimen de pago básico” deben respetar dichas prácticas en todas las hectáreas de su explotación. Se consideran prácticas beneficiosas para el clima y el medio ambiente: la diversificación de cultivos, el mantenimiento de los pastos permanentes existentes y contar con superficies de interés ecológico en la explotación (barbecho, superficies dedicadas a cultivos fijadores de nitrógeno, superficies forestadas y superficies dedicadas a agrosilvicultura). Estas prácticas de “greening” buscan mejorara el comportamiento ambiental y de cara al cambio climático de las explotaciones.
