Austria The Austrian tobacco law was amended in August 2015 and introduces new definitions of novel tobacco products (such as e-cigarettes, etc.). In a first step, it provides the same regulations regarding somking bans in public places (including restaurants) for all novel tobacco products. Since 20 May 2016, the regulations of the 2014 EU tobacco product directive (no. 2014/40/EU) and its delegated acts had to be implemented into national law. Accordingly, chewing tobacco is prohibited and a system for the authorisation of novel tobacco products has been introduced. In addition, comprihensive surveillance and control measures have been imposed. The Austrian Agency for Health and Food Safety (AGES) is tasked to manage all these obligations under the authority of the FMoH. In May 2018, further comprehensive smoking bans in public places came into force. Special mention should be made of further requirements regarding non-smoker protection regulations in clubs, open spaces for schools, an absolute ban on smoking in all public transport as well as anchoring smoking bans also in private vehicles in the presence of young people under the age of 18. The previous age for smoking permits was raised in the youth protection regulations of the federal states to the age of 18 (previously 16). In January 2019, a statutory sales ban for young people under the age of 18 was standardized for all tobacco and related products. In November 2019, an absolute ban on smoking was introduced for the entire catering trade (including night and shisha bars); the previous government (XXVI. legislative period) decided to maintain the special regulations for the catering trade (with a mere partial ban on smoking in such facilities). Bulgaria In 2019, for the first time in the national legislation, through an amendment to the Health Act (Article 218), liability was introduced for the manager of a public place who has allowed smoking of tobacco products and hookah in a closed public space, to be sanctioned for failing to create the necessary conditions and organization, allowing smoking and breaching the ban introduced. In the Child Protection Act (Article 5b), with the following amendments and additions: "and tobacco" shall be replaced by "tobacco and related tobacco products". These changes are made for the purpose of enacting provisions covering tobacco and related tobacco products, namely: Art. 5b The offering and saling of alcoholic beverages, tobacco and related tobacco products to children shall be prohibited. Art. 45. (1) (New, SG No. 38/2006, amended, SG No. 14/2009, supplemented, SG No. 58/2019) The persons selling alcoholic beverages or tobacco and related tobacco products to children, shall be punished by a fine or property sanction from 2,000 to 4,000 BGN, unless it is subject to more severe administrative punishment under a special law, or if the action does not constitute a crime. In case of repeated violation, compulsory measures shall be taken to suspend the activity for a fixed period, but not longer than one year. Jordan In 2017, Jordan was selected to receive support from WHO FCTC 2030 project among other 15 countries. This is a global project, supported by the UK government to accelerate the implementation of the WHO FCTC treaty. This allowed Jordan to have a full time dedicated focal point for tobacco control as well as funding for tobacco control activities to support government of Jordan. WR, in agreement with WHO FCFC Head of Secretariat, decided to pilot an innovative way of collaboration, also in light of UN Reform, and positioned the Tobacco control focal to the UN Resident Coordinator Office in Jordan, providing a unique best practice and opportunity to work on multisectoral action and to collaborate with all UN agencies convening a message on tobacco control as one UN family in Jordan. In 2017, as part of the WHO FCTC2030 project and upon request of the Jordan Ministry of Health, the “Jordan Tobacco Control Economic Investment Case” was initiated. This economic study provided the first systematic analysis of the health and economic burden of tobacco use as well as estimates on the potential health and economic gains from the effective implementation of the WHO FCTC treaty in Jordan. The data generated through this study provided the basis to start the discussion with non-health related ministries and shifting the tobacco alarming situation to a financial governmental concern. In 2019, upon showing data of the “Jordan Tobacco Control Economic Investment Case”, H.E the Prime Minister took the leadership in establishing the “National Multi-Sectorial Committee for Tobacco Control”, bringing together key ministerial portfolios around a common Government goal to combat the growing economic and disease burden of tobacco in Jordan through the implementation and enforcement of the WHO FCTC cost-effective and life-saving measures.
